Global Recognition of Korea’s Patent Expertise

South Korea has emerged as a preferred destination for international patent pre-examinations, ranking fourth globally in the number of Patent Cooperation Treaty (PCT) requests received last year. This achievement underscores the global recognition of Korea’s robust patent examination capabilities, particularly in advanced industries such as semiconductors and telecommunications.

A Closer Look at the 2022 PCT Filings

In 2022, South Korea processed a remarkable 30,023 PCT pre-examination requests. This figure places the country just behind patent powerhouses such as Europe, China, and Japan. Notably, European patent offices received the most requests with 80,125 filings, followed by China and Japan with 72,923 and 47,342 requests, respectively.

Domination by Domestic Giants

The lion’s share of Korea’s PCT filings—73.8% or 22,164 cases—originated from domestic companies. Leading the charge were South Korea’s tech giants such as Samsung Electronics, LG Electronics, and LG Energy Solution, collectively accounting for 35% of the total filings. The sectors that saw the most activity were digital communication, batteries, computers, medical technologies, and audio-visual technologies.

International Interest and Leading Foreign Corporates

Korea’s patent capabilities have also caught the attention of major international corporations, with approximately 24% of the filings—7,155 cases—coming from foreign entities, primarily from the United States. Prominent U.S. companies like Applied Materials, Intel, and Lam Research have shown a strong preference for Korean pre-examinations, with Applied Materials having 99.6% of their PCT filings reviewed in Korea over the past five years.

Future Prospects and Government Commitment

According to Shin Sang-gon, the Director of Patent Examination Planning at the Korean Intellectual Property Office, the growth trend in PCT international examinations is expected to continue, driven by advancements in AI and semiconductor technologies. He emphasized that the results from these examinations are crucial for patent assessments and that the office is committed to maintaining high standards in its examination processes.
